These Terms of Service ("Terms") govern your use of the Boltzmann Labs websites, including boltzmannlabs.com, and our products — including Peachy Assist at peachyassist.com and the Peachy Assist application. By using our sites or services, you agree to these Terms. If you do not agree, do not use the sites or services.
Boltzmann Labs is an AI software and research company based in Florida, United States. Peachy Assist is our unified communication, AI automation, and voice/SMS platform used by businesses to manage customer bookings, email, messaging, CRM data, and documents.
You may need to create an account to use certain features. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us at info@boltzmannlabs.com if you suspect unauthorized use.

You retain ownership of any content you submit to the service ("Your Content"). You grant Boltzmann Labs a worldwide, non-exclusive license to host, process, and display Your Content solely to provide the service to you. We do not claim ownership of Your Content and we do not use it to train models for other customers unless you explicitly opt in.
The service uses third-party large language models to generate text, images, and other output. AI output may contain errors. You are responsible for reviewing it before relying on it for any decision, and for ensuring its use complies with applicable laws.
By providing your mobile phone number to Boltzmann Inc. — on a signup form, in a booking flow, in your account settings, or verbally to our voice agent — you consent to receive transactional text messages from us under the following terms:
No mobile information (phone numbers, opt-in status, or the content of messages exchanged) is shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers and consent records are used exclusively to deliver the transactional messages described above and to comply with U.S. carrier requirements.

Paid features are billed in advance through Stripe. By providing payment information you authorize Boltzmann Labs to charge the applicable fees. Subscriptions renew automatically until cancelled. You can cancel any time from your account; cancellations take effect at the end of the current billing period. We do not provide pro-rata refunds for partial periods, except where required by law.
You may delete your account at any time. We may suspend or terminate access to the service immediately if you breach these Terms, if continued service creates a legal or security risk, or if required by law. Sections 3, 4, 5, 8, 9, and 10 survive termination.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Boltzmann Labs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or related to your use of the service. Our aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the claim and (b) one hundred US dollars (US$100).
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Florida.
We may update these Terms from time to time. When we make material changes we will notify you by email or by a prominent notice in the service before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
